Rules & Regulations

HOW TO ENTER:

No purchase necessary. The contest begins on March 1, 2008 and ends on May 30, 2008 (the "€œContest Period"€). Entries will only be accepted online at www.explore-mag.com

Enter as often as you like during the Contest Period. Entries will be rejected if the online entry form is not fully completed or is not received by the Submission Deadline.

The digital photo must represent the quality and character of the original digital capture. Colour correction and tonal cast changes are acceptable; compositional changes will result in automatic disqualification.

Do not mail negatives or CDs with your entry as no entries will be returned. However, if a Photo is chosen as a winner, all original material, including negatives or digital capture files, must be made available to Explore Media Inc. as a condition of receiving a prize.

ELIGIBILITY:

Contest is open to legal residents of Canada except employees (and those with whom such employees are domiciled) or agents Explore Media Inc., their respective advertising and promotion agencies, and the contest judges. Entrants 13 years of age or younger must have consent from their parent or legal guardian to enter this Contest. In the event it is discovered that you entered without consent from your parent or legal guardian, all entries will be void.

SUBMISSION REQUIREMENTS:

We are looking for photos of outdoor fun within Canada to be eligible to win. You will require the consent of all individuals who are included in the Photo and consent from the individuals who own the personal property featured in the Photo. The submitted Photo must never have been previously published, exhibited publicly, or selected as a winner in any other contest and only amateur photographers are eligible (defined as a person who has never earned more than $1,000 in any year for photography). All Photos submitted become the property of the Explore Media Inc. Entries not complying with these contest rules will be disqualified.

THE PRIZE APPROXIMATE RETAIL VALUE: $1,750

Prizes must be accepted as awarded and are not transferable or convertible to cash. No substitutions except at the Explore Media Inc.'€™s option. Explore Media Inc. reserves the right to substitute a prize or a prize component with one of equal or greater value. Prizes will be shipped to the winner at the expense of Explore Media Inc. Taxes on prize may be the sole responsibility of the winner. If the winner is a minor in his/her province or territory of residence, such winner'€™s parent or legal guardian must accept the prize on his/her behalf. WINNER SELECTION:

A panel of judges consisting of professional photographers will judge all Photos submitted on the basis of originality, creativity and technical proficiency. Photos which are illegal, defamatory or in any way obscene, will be disqualified. Judging will be completed and the winner contacted by June 6, 2008. If you have not been contacted by this date, you may assume that your entry is not a winner.

Odds of a Photo being selected by the contest judges as the winner of a prize depends on the number and calibre of entries received. By accepting a prize, winner agrees that their Photo becomes the property of the Explore Media Inc. and will not be returned. Winner grants Explore Media Inc. the right in perpetuity to publish and use winner€'s Photo, as is or as may be edited in Explore Media Inc.'s sole discretion, accompanied by winner's full name and city of residence in any advertising and promotion by Explore Media Inc. without further compensation, including but not limited to Explore Media Inc.'s website, explore magazine, or brochures. Selected winner agrees to assign all intellectual property rights including copyright, and waive all moral rights in and to the Photo in favour of Explore Media Inc.

GENERAL CONDITIONS:

No correspondence will be entered into except with the selected winners.

This contest is subject to all applicable federal, provincial, and municipal laws. Void where prohibited by law. The decisions of the contest judges with respect to all aspects of this contest are final and binding on all entrants without right of appeal.

The selected winner (or winner'€™s parent or legal guardian if a minor) will be required to sign and return a standard Declaration, Liability and Publicity Release, releasing Explore Media Inc., their respective advertising and promotional agencies and the contest judges from any and all liability arising directly or indirectly from this contest, participation in contest related activities, the awarding of a prize and the use or misuse of any prize. By entering the contest selected winners agree to comply with these official contest rules and agree to the publication, reproduction, and/or other use of his/her name, address, voice, statements about the contest, and/or personal photograph or other likeness without further compensation, in any publicity or advertisement carried out by the Explore Media Inc. in any manner whatsoever, including print, broadcast, or the Internet.

Explore Media Inc., its advertising and promotion agencies and the contest judges are not responsible for late, lost, misdirected, delayed, or illegible entries, nor are they responsible for technical issues with the website that may prevent entry. Without limitation, Explore Media Inc., its advertising and promotion agencies, and the contest judges will not be liable for the failure of any entry or Photo to be received.

Explore Media Inc. reserves the right to withdraw or amend this contest in any way, in the event of an error, technical problem, tampering, unauthorized intervention, fraud, technical failure, or any other cause beyond the reasonable control of Explore Media Inc. that interferes with the proper conduct of this contest as contemplated by these Rules. Any attempt to deliberately undermine the legitimate operation of this contest is a violation of criminal and civil laws and should such an attempt be made, Explore Media Inc. reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Explore Media Inc., reserves the right to cancel or suspend this contest in the event of any accident, printing, administrative, or other error of any kind without prior notice or obligation.

By entering this contest, each entrant expressly consents to Explore Media Inc., its agents and/or representatives, storing, sharing, and using the personal information submitted with his/her entry only for the purpose of administering the contest and in accordance with Explore Media Inc. Privacy Policy found at www.explore-mag.com unless the entrant otherwise agrees.
